Cookie Pop-ups - Take a Closer Look

All those cookie pop-ups can be really annoying, for sure. What we find more annoying is that tab that says ‘Legitimate Interest’. So what does that mean?

Legitimate Interest (LI) is one of the General Data Protection Regulation’s lawful bases for processing.

So, the website you are on shares your personal information with their third party vendors claiming LI as the lawful basis for processing.

The thing is, at the time of writing, to claim LI as a lawful basis, there is supposed to be a balance of benefits. The Information Commissioners Office even provides a Legitimate Interest Three Part Test template to validate an assertion that LI is a valid lawful basis for processing YOUR information.

If you check the links on the cookie popups, you will often see that the third party vendor claims LI because THEY have a legitimate interest in processing YOUR information.

Do you think they have performed LI three part tests and really considered the impacts or benefits to you, the data subject?

Before you click ‘accept all’, remember to check the Legitimate Interest tab and make sure you are happy that all of those companies process your information before you use the site.
